These Sweepstakes Rules (the “Official Rules”) govern when you (“you” or “Entrant”) participate in the $10,000 Prize Giveaway! (the “Sweepstakes”) appearing on the official Pardon My Cheesesteak Instagram Page, https://www.instagram.com/pardonmycheesesteak/ (the “PMC Instagram Page”) and Pardon My Cheesesteak X Page, https://x.com/PardonMySteak (the “PMC X Page”; each, a “PMC Social Page”). By participating in the Sweepstakes, Entrant agrees to these Official Rules by Sponsor, and any amendments to these Official Rules which may be made from time to time and posted at this URL and will be effective when posted. Entrant’s continued participation in the Sweepstakes after the amendments are posted constitutes Entrant’s agreement to those amendments. Sponsor is not responsible for any contests or sweepstakes on pages other than the PMC Social Pages. The Sweepstakes is open to legal residents of Ohio, Georgia, Illinois, Indiana, Kansas, Kentucky, Michigan, Missouri, North Carolina, Pennsylvania, South Carolina, Tennessee, Virginia, and West Virginia ONLY who are 18 years of age or have reached the age of majority in their jurisdictions of residence, at the time of entry. Void in all other U.S. states, U.S. territories, possessions, commonwealths, military installations outside the continental United States, and where prohibited by law. Employees and agents of Virtual Dining Concepts, LLC, Penn Station Inc., Barstool Sports, Inc., and their respective parent companies, subsidiaries, franchisees, licensees, affiliates, advertising agencies, public relations agencies, prize suppliers, including any vendors providing services in connection with this Sweepstakes (collectively, the “Sponsor Affiliates”), and employees, agents, directors, officers (including members of their immediate family – i.e., spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren – or those living in the same household) of Sponsor or any Sponsor Affiliates are not eligible to participate in the Sweepstakes. YOU MUST HAVE AN INSTAGRAM OR X ACCOUNT TO PARTICIPATE.
The Sweepstakes begins at 9:00a.m. Eastern Time (“ET”) on November 5, 2025, and ends at 11:59p.m. ET on December 15, 2025 (the “Entry Period”). Sponsor shall have the sole discretion in determining the timeliness of any action or inaction related to the Sweepstakes.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Please complete the following steps during the applicable Promotion Period:
One (1) entry per person during the Entry Period. All entries must be received during the Entry Period. In the event of multiple entries being received from the same individual during the Entry Period, only the first entry will be accepted. You may not post on multiple PMC Social Pages to receive multiple entries.
Each Entrant’s account and any entry posting made by an Entrant must be set to “public” and the Entrant must follow @PardonMyCheesesteak (in the case of Instagram) or @PardonMySteak (in the case of X) to be eligible. You can return your account to “private,” delete entry posts, and unfollow @PardonMyCheesesteak or @PardonMySteak, as applicable, any time after the winner announcement for that sweepstakes. Entries generated by script, macro, or other automated means of by any means which subvert the entry process are void. Entries become the property of Sponsor and will not be returned. Sponsor reserves the right to disqualify any Entrant in its sole discretion.

After the close of the Entry Period, Sponsor will randomly select two (2) potential winners from all eligible entries received during the Entry Period. All random drawings will be conducted under the supervision of the Sponsor, whose decisions are final. Odds of winning depend on the number of eligible entries received during each Entry Period. Limit one (1) prize per person.
Each of the potential winners (each, a “Potential Winner”) will be contacted via social media and will have to verify their name, age and address with a government-issued form of identification within twenty-four (24) hours following the time Sponsor sends the direct message (the “Notification Period”). If any Potential Winner is not reachable by the end of the Notification Period, or if the Potential Winner does not qualify for the prize, the applicable Potential Winner will forfeit the prize in its entirety and another alternate Potential Winner will be randomly selected as the Potential Winner, who will be subject to the same process. The Sponsor and Sponsor Affiliates assume no responsibility for undeliverable messages, emails, or other communication including but not limited to any form of filtering, be it active or passive, by a social media platform, email, or other service provider, or for full or unavailable email services.
The Potential Winners will be required to complete, sign, have notarized and return the presented affidavit of eligibility, liability waiver, and publicity release, and the appropriate tax documents (the “Documents”) via the secure electronic notary process provided by Sponsor or other method acceptable to the Sponsor, within three (3) business days of delivery of the Documents. Failure to return the fully-executed Documents by the stated deadline will result in forfeiture of the Prize in its entirety.
If a notified Potential Winner is not eligible, forfeits the prize, or declines the prize, an alternate winner may be randomly selected as a Potential Winner, time and circumstances permitting, at the Sponsor’s sole discretion. Return of any prize notification or prize as undeliverable or failure to accept any prize within the specified time period may result in disqualification and forfeiture of the prize.
Within three (3) business days of receipt of each Potential Winner’s fully executed Documents, Sponsor will contact each Potential Winner with their final winner status. Confirmed winners will each receive a corporate check from Virtual Dining Concepts, LLC. Within four (4) to six (6) weeks after winner confirmation, the check will be sent via regular U.S. mail in a plain business window envelope with Virtual Dining Concepts, LLC’s return address. The winner may also be announced on social media after accepting the prize. Sponsor reserves the right to share the winner’s social media handle publicly at the time of being announced as a winner.

By entering, Entrant grants to Sponsor and the Sponsor Affiliates a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, sub-licensable, assignable license to reproduce the Entrant’s entry (including, without limitation, any and all submitted information) and to otherwise use, exploit, copy, modify, adapt, edit, publish and display the entry (including, without limitation, any and all submitted information) in any form, manner, venue, media or technology now known or later developed for any and all purposes, including, without limitation, for purposes of trade, advertising, and promotion as Sponsor and the Sponsor Affiliates and their respective licensees or assignees determine, without further compensation, notification, or permission. Further, by entering the Sweepstakes, Entrant hereby waives any moral rights the entrant may have in the entry (including, without limitation, any and all submitted information) in favor of Sponsor and the Sponsor Affiliates. At Sponsor’s request and in its sole discretion, entrants may be required to execute an assignment and release transferring all rights and ownership of their entry to Sponsor or the Sponsor Affiliates, the form of such assignment to be determined by Sponsor in its sole discretion. Entrant warrants and represents to Sponsor that the entrant has all necessary rights and permissions to grant Sponsor and the Sponsor Affiliates the rights contained in this paragraph.
By participating in the Sweepstakes, Entrant also grants to Sponsor and the Sponsor Affiliates the worldwide, perpetual, irrevocable, fully sub-licensable, and transferable right, but not the obligation, to use any and all names, identities, titles, likenesses, distinctive appearances, physical likenesses, images, portraits, pictures, photographs (whether still or moving), screen personas, voices, vocal styles, statements, gestures, mannerisms, personalities, performance characteristics, biographical data, signatures, and any other indicia or imitations of identity or likeness listed, provided, referenced, or otherwise contained in the entry (including, without limitation, any and all submitted information) for purposes of advertising and trade, in any format, medium, or technology now known or later developed without further notice, approval, or compensation, unless prohibited by law. Entrant warrants and represents to Sponsor that the entrant has all necessary rights and permissions to grant Sponsor the rights contained in this paragraph.
The information Entrant provides to Sponsor will only be used in accordance with Sponsor’s Privacy Policy. You also confirm that you understand that your personal data will be processed by the Sponsor and you consent to being contacted by the Sponsor for marketing purposes using the contact details you provided in connection with your participation in Sweepstakes. Information on the processing of data by the Sponsor is located at https://joinvdc.com/privacy-policy/. Decisions of Sponsor on all matters related to the Sweepstakes are final and binding. Sponsor reserves the right to cancel or modify the Sweepstakes for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Sweepstakes, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Sweepstakes as determined by Sponsor, in its sole discretion. Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in the Official Rules. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY APPLICABLE LAW.
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Middle District of Florida or the appropriate Florida State Court located in Orange County, Florida; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
Sponsor and the Sponsor Affiliates are not responsible for: (1) any incorrect or inaccurate information either caused by printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes or provided by entrants; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections to the internet, in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Sweepstakes, including but not limited to the entry process; (4) technical or human error which may occur in the administration of the Sweepstakes, including but not limited to the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes, or to the receipt, use, inability to use, or misuse of any prize. If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Sweepstakes, if it is possible.
By entering the Sweepstakes, Entrant agrees to release, discharge and hold harmless Sponsor and the Sponsor Affiliates, and their respective directors, officers, employees, agents, assigns, affiliates, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies (the “Released Parties”) from any claims, injury, death, losses, and/or damages that may occur, directly or indirectly, whether caused by negligence or not, arising out of, or relating to, your participation in the Sweepstakes or any Sweepstakes-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder (including, without limitation, any misrepresentation made by you in connection with the Sweepstakes; any non-compliance by you with the Official Rules; claims brought by persons or entities other than the parties to the Official Rules arising from or related to your involvement with the Sweepstakes; acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in the Sweepstakes; any malfunction, error or other problem arising in connection with the collection, processing, or retention of entry information; or any typographical or other error in the printing, offering or announcement of any winner). The foregoing includes, without limitation, any claim for personal injury, property loss or damage, or death arising in any way in connection with the Sweepstakes.
If Sponsor’s or the Sponsor Affiliates’ use of an entry causes Sponsor and/or the Sponsor Affiliates to be subject to a claim by any third party (including, but not limited to, a claim of infringement), such participant agrees to indemnify and hold harmless the Released Parties, and all persons acting by, through, under or in concert with them, against any and all damages, costs, judgments and expenses (including reasonable attorney’s fees) which the Released Parties (or any one of them) may incur as a result of the use of your entry.
Unless otherwise specified, the Sweepstakes is in no way sponsored, endorsed or administered by, or associated with any social media platform or any other named or depicted people or entities other than Sponsor. Any questions, comments or complaints regarding the Sweepstakes should be directed to Sponsor.
Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected; if the individual fails to comply with any requirement of participation or with any provision in these General Rules or the Official Rules; if the individual’s behavior or communication at any point is disruptive, may or does cause damage or to any person, property, or reputation of Sponsor, or is otherwise not in accordance with all applicable laws and generally accepted social practices as determined in Sponsor’s sole discretion.
If any provision(s) of the Official Rules are held to be invalid or unenforceable, all remaining provisions thereof will remain in full force and effect.
